UTILITARIANISM, CATEGORICAL IMPERATIVE, AND THE DIGNITY OF THE HUMAN PERSON AS STARTING POINTS FOR JUDICIAL DECISIONS
Abstract
This study intends to present in which forms the law’s philosophy, and specially the utilitarianism, the categorical imperative, and the dignity of the human person can help the judges in hard decisions. Initially, the study intends to explain the philosophic thought, and then analyse its aplications on some brazilian supreme court’s decisions.
