Abstract

The thematic of the regularity in the production of evidence in the criminal persecution is probably the most recurring subject in the routine of superior Courts, specially the Brazilian Superior Court of Justice. Previous knowledge regarding evidence production, specifically in the case of precautionary evidence is no longer sufficient for the mainteinance of a sound procedural instruction, recquiring of the agents involved in the criminal persecution that they follow the jurisprudence of superior courts. In the current article, the themes of the significant sensitivity of current criminal investigations such as the application of the theory of appearance and its nuances related to the inviolability of homes.
