Abstract

Is the State given a true legal duty to supply medicines without registration with the National Health Surveillance Agency – ANVISA? Given the relevance of the theme, once present in the daily life of the Brazilian courts, the objective of this article is to provide a satisfactory dogmatic answer to the question by consulting the specialized bibliography. The conclusion is that one of the public policies enacted by Brazil to meet the right to health (article 196 of the Constitution of the Republic) is precisely the prohibition of the importation, industrialization and commercialization, in the national territory, of medicines without registration with ANVISA – a finding that corroborates the thesis that there is no authentic state duty in this sense.
