PARENTAL ALIENATION: CONCEPTUAL ORIGIN AND PRACTICAL REPERCUSSIONS
Abstract
The present work is dedicated to the understanding of the concept of Parental Alienation, its incorporation and applicability in the Brazilian context, questioning the capacity of intervention of Law in the solution of family conflicts and preventing the practice of psychological abuse against children and adolescents. The analysis starts from identifying the conceptual origin of Parental Alienation and fundamentally addresses the aspects linked to the effective application of Law n.º 12,318/2010, considering both the critical elaborations regarding it and the benefits of the Parental Alienation Law of point of view of concrete protection of the rights of children and adolescents. The study points, in the end, to the importance of the necessary articulation between the different fields of knowledge, in the perspective of ensuring the effective and coherent application of the Parental Alienation Law.
