Abstract

This subject aims the study of the institute of the joint action, his basic notions, classifications, legal tratment, specially the active compulsory joinder, and the seeming constitutional principles conflict of access to justice and free will created by him. Then, we will enumerate the main doctrinaire positioning on such subject, from the institutes’s acceptance itself, to the procedures mechanisms to enable the integration of the co plaintiff that do not wish to litigate.
