CONSTITUTIONALITY CONTROL AND ITS IMPORTANCE FOR THE PRESERVATION OF DEMOCRACY IN CONTEMPORARY BRAZIL
Abstract
This paper analyzes the judicial review and its role in Brazilian democracy. Initially, the concept of judicial review and its types in Brazil are addressed. Then, the importance of this mechanism for maintaining the Rule of Law and the countermajoritarian difficulties faced by Supreme Courts are discussed. The study concludes that judicial review is essential to ensure that laws and normative acts comply with the Constitution, protecting fundamental rights and ensuring legal stability.
