PROVISIONAL EXECUTION OF JUDICIAL TITLE IN THE NEW CODE OF CIVIL PROCEDURE: ANALYSIS OF THE CASES FOR WAIVING THE GUARANTEE

Abstract

This study deals with Provisional Execution, specifically, with the hypotheses for waiving bail. Its objective is to examine the changes brought about by the 2015 Code of Civil Procedure regarding this institute, the doctrinal and jurisprudential positions pertinent to the subject, positive and negative points of the legal changes introduced by Law No. 13,105/2015, as well as the practical importance of the hypotheses for waiving bail in the Brazilian legal system. To this end, extensive research was carried out on the subject, in doctrines, articles, monographs, legislation, bills and jurisprudence. Thus, the work will address the main aspects related to the subject.
