FROM STATE JURISDICTION TO THE MULTI-DOOR COURTHOUSE: A NEW PARADIGM IN ACCESS TO JUSTICE
Abstract
This paper analyzes the Multi-Door Courthouse model as an alternative and complement to the traditional judicial system, in light of the growing demand for faster, more adequate, and more effective solutions to social conflicts. Starting from the historical evolution of jurisdiction and the consolidation of the state monopoly in dispute resolution, the study examines Frank Sander’s proposal and its reception in Brazilian law, particularly through the National Council of Justice Resolution No. 125/2010 and the 2015 Code of Civil Procedure. The research highlights the main consensual and adjudicative mechanisms, such as conciliation, mediation, arbitration, and criminal law instruments, emphasizing their role in fostering social pacification. It concludes by underscoring the importance of the Multi-Door Courthouse model as a tool for democratizing access to justice, enhancing party autonomy, and strengthening the
Rule of Law.
