Abstract

The article analyzes legislative innovations in the Brazilian legal system aimed at protecting women, considering the symbolic function of Criminal Law and the effective protection of legally protected interests. The study reflects on the Maria da Penha Law, the Brazilian Penal Code, and subsequent legislative amendments, examining whether the tightening of criminal legislation regarding women's rights has truly been effective in ensuring such protection, or whether Criminal Law is being applied merely in its symbolic dimension. Through bibliographic and documentary review, the research identifies the need for adopting not only repressive but also preventive measures, in order to effectively guarantee women's right to human dignity.
